Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and WhaleAlert ("Company," "we," "us," or "our") governing your access to and use of the WhaleAlert mobile application ("App") and related services.
BY DOWNLOADING, INSTALLING, OR USING WHALEALERT, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
1. Service Description
1.1 What WhaleAlert Provides
WhaleAlert is a Solana mobile application that enables users to:
- Follow and monitor curated Solana whale wallets
- Receive real-time push notifications for whale swap activity
- View trade history, token flows, and copy-trade activity
- Execute user-authorized copy trades through supported integrations
1.2 User-Authorized Execution
WhaleAlert provides monitoring plus user-authorized trade execution. We:
- Access only publicly available blockchain data
- DO NOT have access to your private keys or seed phrases
- CANNOT sign transactions on your behalf
- Only submit copy trades after you explicitly authorize the transaction in your wallet
- DO NOT custody or hold any cryptocurrency
1.3 No Financial Advice
WhaleAlert provides workflow tooling and informational market data. We do not provide investment advice, trading signals, or financial recommendations. Any decisions you make based on information from the Service are solely your responsibility.
2. Eligibility
You must be at least 18 years old to use WhaleAlert. You are responsible for ensuring that your use complies with all applicable laws in your jurisdiction.
3. Account Terms
- Create an account with accurate, complete information
- Maintain the security of your login credentials
- Accept responsibility for all account activity
- Report security issues to: support@whalealert.fun
4. Fees and Trading Terms
- Copy trades may include routing fees, slippage, network fees, and referral fees
- All blockchain transactions are final once submitted onchain
- Quoted prices may change before you sign or before the transaction executes
- Refunds are generally not available for irreversible blockchain transactions
5. Acceptable Use
You agree NOT to:
- Reverse engineer, decompile, or modify the App
- Attempt to access unauthorized systems or data
- Use the Service for harassment, stalking, or surveillance
- Track wallets to facilitate fraud, theft, or illegal activity
- Share account credentials or resell the Service
6. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:
- All transactions will be detected
- Notifications will be delivered instantly
- Blockchain data is complete or error-free
- The Service will be available 100% of the time
We are not responsible for any financial losses related to cryptocurrency.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
- Amounts paid by you in the 12 months preceding the claim, OR
- One hundred U.S. dollars ($100)
8. Dispute Resolution
Before initiating formal proceedings, contact us at support@whalealert.fun to attempt resolution. Disputes not resolved informally shall be settled by binding arbitration.
YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS.
These Terms are governed by the laws of the State of Delaware, United States.
9. Changes to Terms
We may modify these Terms at any time. Continued use after changes constitutes acceptance.
